Please read these Terms and Conditions (“Terms”) before using the Bad Memory app, website, or related services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms.
Acceptance of these terms
By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you confirm that you have authority to accept these Terms for that organization.
You must be legally able to enter into this agreement and old enough to use online services in your jurisdiction. If local law requires consent from a parent or legal guardian, you may use the Service only with that consent.
The Service
Bad Memory helps you create and organize a private personal history. Features may include timelines, memories, dates, notes, people, places, categories, search, and rediscovery experiences.
We may improve, add, remove, or change features over time. Preview, beta, or pre-release features may be incomplete and may change before a public release.
Your account
You are responsible for providing accurate account information, keeping your login credentials confidential, and for activity that occurs through your account. Please contact us promptly if you believe your account has been accessed without your permission.
You may not impersonate another person, create an account for someone without their permission, or use the Service in a way that misrepresents your identity.
Your content
You retain ownership of the memories, notes, images, and other material you add to the Service (“Your Content”). You give us permission to host, process, reproduce, and display Your Content only as needed to operate, maintain, secure, and improve the Service for you.
You are responsible for Your Content and for making sure you have the right to add it. Your Content must not violate another person’s rights or applicable law.
Acceptable use
You agree not to misuse the Service. Among other things, you may not:
- Use the Service for unlawful, fraudulent, harmful, or abusive activity.
- Attempt to access another person’s account or private information.
- Interfere with the Service, its security, or its normal operation.
- Introduce malicious code or use automated tools in a disruptive manner.
- Copy, reverse engineer, or resell the Service except where law permits it.
- Use the Service to infringe intellectual property or privacy rights.
Privacy
Your use of the Service is also subject to our privacy disclosures. Bad Memory is designed as a personal archive, not a public social network. You should still use care when adding sensitive information about yourself or other people.
If a feature allows you to share information, you are responsible for choosing what to share and who may receive it.
For more information about how we handle personal information, please read our Privacy Policy.
Availability and changes
We work to keep the Service available and useful, but access may occasionally be interrupted for maintenance, updates, technical issues, or circumstances outside our control. We do not guarantee that every feature will always be available or that the Service will be error-free.
We may suspend or end access when reasonably necessary to protect the Service, comply with law, address misuse, or discontinue the Service. Where practical, we will provide notice of material changes that affect your access.
Third-party services
The Service may depend on or link to third-party services, such as device platforms or sign-in providers. Those services are governed by their own terms and policies. We are not responsible for third-party services that we do not control.
Disclaimers
To the extent permitted by law, the Service is provided “as is” and “as available.” We disclaim warranties that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Bad Memory is a personal record-keeping tool. It is not medical, legal, financial, or emergency advice, and it should not be your only copy of information you cannot afford to lose.
Limitation of liability
To the extent permitted by law, Bad Memory and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or business opportunity arising from your use of the Service.
Some jurisdictions do not allow certain warranty exclusions or liability limitations. In those places, these provisions apply only to the extent allowed by law, and you may have additional rights.
Changes to these terms
We may update these Terms as the Service evolves or as legal requirements change. If an update is material, we will provide reasonable notice through the Service or by another appropriate method. The effective date at the top of this page shows when the latest version took effect.
Continuing to use the Service after updated Terms take effect means you accept the revised Terms. If you do not agree to an update, you should stop using the Service.
